You agree to use this website only for lawful purposes.
You must not:
- use the website in a way that could damage, disable, or interfere with its functionality;
- attempt to gain unauthorized access to the website, server, forms, systems, or connected tools;
- copy, reproduce, or reuse website content without permission;
- submit false, misleading, harmful, or unlawful information through the contact form;
- use the website for spam, automated scraping, or malicious activity.
I reserve the right to restrict access to the website or take appropriate action if misuse is detected.
4. Enquiries and project requests
When you contact me through the website, you may be asked to provide details about your business, analytics setup, tools, goals, and project needs.
Submitting an enquiry does not guarantee that I will accept the project. I may decline a request if it is outside my area of expertise, if there is a conflict of interest, if timelines are not feasible, or for any other reasonable business reason.
Any proposal, recommendation, estimate, or timeline shared before a formal agreement is for discussion purposes only and may change once the full project details are reviewed.
5. Client responsibilities
For a project to be delivered properly, you may need to provide accurate information, access, feedback, approvals, and technical support where required.
Depending on the project, you may be responsible for providing access to tools such as:
- Google Analytics 4;
- Google Tag Manager;
- Google Ads or other ad platforms;
- BigQuery;
- Looker Studio;
- website CMS or ecommerce platforms;
- mobile app analytics platforms;
- CRM systems;
- cookie consent platforms;
- server-side tagging environments;
- data layer documentation;
- development resources.
You are responsible for ensuring that you have the authority to grant access to these systems and that the information you provide is accurate and complete.
Delays in access, feedback, approvals, or technical implementation may affect project timelines and delivery dates.
6. Third-party platforms and tools
Many analytics and tracking projects depend on third-party platforms, including Google Analytics, Google Tag Manager, Google Ads, BigQuery, Looker Studio, Meta, CRM platforms, cookie consent tools, ecommerce platforms, and other marketing or data systems.
I do not own or control these third-party platforms. Their functionality, availability, pricing, policies, data processing rules, reporting methods, and technical requirements may change at any time.
I am not responsible for issues caused by third-party platforms, including:
- platform outages;
- bugs or limitations;
- changes to APIs or tracking rules;
- data delays or discrepancies;
- consent or browser restrictions;
- ad blocker impact;
- attribution changes;
- account suspensions;
- changes in platform documentation or policies.
Where possible, I will recommend practical solutions, but I cannot guarantee that any third-party platform will behave in a specific way or produce identical results across different tools.
7. Analytics accuracy and measurement limitations
Digital analytics is designed to improve visibility, measurement, and decision-making, but no tracking setup can guarantee 100% complete or perfectly accurate data.
Data may be affected by factors such as:
- cookie consent choices;
- browser restrictions;
- ad blockers;
- device settings;
- tracking prevention technologies;
- cross-device behavior;
- platform attribution differences;
- implementation limits;
- server or network issues;
- incomplete data layer information;
- delayed or sampled reporting;
- changes in platform methodology.
I aim to build reliable, well-documented, and technically sound measurement systems, but you acknowledge that analytics data should be interpreted as directional business intelligence rather than an exact record of every user action.
8. Compliance and privacy responsibilities
Some services may involve tracking, consent configuration, data collection, analytics tools, advertising pixels, CRM data, or offline conversion imports.
I can support technical implementation and provide best-practice recommendations, but I do not provide legal advice.
You are responsible for ensuring that your website, app, cookie banner, privacy policy, consent setup, data processing activities, and marketing technologies comply with applicable laws and regulations, including privacy, data protection, consumer protection, and advertising rules.
You should consult a qualified legal or privacy professional for advice on legal compliance, privacy notices, cookie consent, data retention, and user rights.
9. Fees, payments, and invoicing
Fees, payment terms, billing structure, and due dates will be agreed separately for each project.
Depending on the project, fees may be fixed, hourly, retainer-based, or milestone-based.
Unless otherwise agreed in writing:
- work begins after the project scope and payment terms are confirmed;
- invoices must be paid by the due date stated on the invoice;
- late payment may delay delivery or pause ongoing work;
- additional work outside the agreed scope may require a separate estimate or approval;
- fees paid for completed work are non-refundable.
Any taxes, bank fees, exchange fees, or payment processing costs may be charged in accordance with the applicable invoice or agreement.
10. Project scope and changes
Each project will have an agreed scope of work. This may include specific deliverables, platforms, pages, events, dashboards, reports, documentation, or consulting hours.
Requests outside the agreed scope may be treated as additional work. This can include, but is not limited to:
- adding new platforms or tools;
- tracking additional events or funnels;
- creating extra dashboards or reports;
- changing the original implementation approach;
- reviewing new website or app changes;
- additional debugging after third-party or development changes;
- extra meetings, documentation, or training.
If additional work is required, I will communicate this before proceeding where practical.
11. Timelines and delivery
Estimated timelines are provided based on the information available at the time of planning.
Delivery dates may depend on:
- access to required platforms;
- client feedback and approvals;
- developer availability;
- third-party platform behavior;
- website or app release schedules;
- data availability;
- complexity of the setup;
- changes to project scope.
I will make reasonable efforts to meet agreed timelines, but delivery dates are not guaranteed unless explicitly confirmed in writing.
12. Confidentiality
During a project, I may have access to confidential business information, analytics data, advertising data, CRM data, technical documentation, revenue data, or internal processes.
I will treat confidential information with care and will not share it with third parties except where necessary to deliver the agreed services, where required by law, or where you have given permission.
You also agree not to share any confidential methods, templates, documentation, proposals, or project materials provided by me without permission.
13. Access and security
Where platform access is required, you should grant access using secure and appropriate permission levels.
You should avoid sharing personal passwords. Where possible, access should be provided through user permissions, role-based access, or secure invitation systems.
You are responsible for managing your own accounts, users, permissions, passwords, billing settings, and platform security.
At the end of a project, you may remove my access from your tools unless ongoing support has been agreed.
14. Intellectual property
All content on this website, including text, structure, design elements, service descriptions, images, and branding, is owned by or licensed to Vlad Simion unless otherwise stated.
You may not copy, reproduce, republish, or distribute website content without written permission.
For client projects, ownership of final agreed deliverables will be defined by the project agreement. Unless otherwise agreed:
- you may use final deliverables created specifically for your business after full payment has been received;
- I retain ownership of my pre-existing templates, frameworks, know-how, processes, methods, and reusable materials;
- you may not resell, redistribute, or claim ownership of my underlying methods, templates, or frameworks.
15. Portfolio, testimonials, and case studies
I may ask for permission to use your company name, testimonial, project summary, or results in my portfolio, website, proposals, or case studies.
I will not publish confidential information, sensitive data, or non-public results without your permission.
If a testimonial or case study is provided, you confirm that it is accurate and that you have the right to approve its use.
16. Website content and no guarantees
The content on this website is provided in good faith for general information.
While I aim to keep the information accurate and up to date, I do not guarantee that all website content will always be complete, current, or error-free.
Nothing on this website should be interpreted as a guarantee of specific results, revenue growth, advertising performance, conversion improvements, tracking accuracy, platform approval, or business outcomes.
Any examples, case studies, testimonials, or service descriptions are illustrative and may not represent the results of every project.
17. Limitation of liability
To the fullest extent permitted by law, I will not be liable for indirect, incidental, special, or consequential losses, including but not limited to loss of revenue, loss of profit, loss of data, loss of business opportunity, advertising losses, platform issues, or reputational damage.
My total liability for any claim related to services will not exceed the amount paid for the specific service that gave rise to the claim, unless otherwise required by law.
Nothing in these Terms excludes liability where it cannot legally be excluded.
18. Links to other websites
This website may include links to third-party websites, tools, platforms, or resources.
